Are You Using the Right Form I-9? Here’s What Changed
U.S. Citizenship and Immigration Services (USCIS) released a new edition of Form I-9 on April 3.
This updated version of the employment eligibility verification form is dated 01/20/25 and is now available for download. It includes minor language adjustments and an updated privacy notice, and is valid until May 31, 2027.
Key updates include:
- Renaming the fourth checkbox in Section 1 to “An alien authorized to work”
- Revising the descriptions of two List B documents in the Lists of Acceptable Documents
- Adding appropriate statutory language and a revised DHS Privacy Notice to the instructions
Employers may continue using previous editions of the form until they expire. These include:
- The 08/01/23 edition, valid through May 31, 2027.
- Another 08/01/23 edition, valid through July 31, 2026. Employers using this version in an electronic system must ensure their system is updated with a Form I-9 showing a 05/31/2027 expiration date by July 31, 2026.
Beginning April 3, E-Verify and E-Verify+ have updated the Citizenship Status selection during case creation to reflect the new terminology, “An alien authorized to work.” Depending on the form version used, some cases in E-Verify may still display the previous phrase, “A noncitizen authorized to work.”
Employers should integrate the new form into their verification processes by July 31, 2026, and make sure relevant staff are aware of the changes. It's also a good time to review Form I-9 procedures and prepare for potential audits or worksite inspections.
